Woman wins $11.3M lawsuit against Target after fracturing ankle in parking lot

ORANGE COUNTY, Fla. (Gray News) – A jury awarded over $11.3 million to a Florida woman who fell in a Target parking lot and broke her ankle.

The 44-year-old woman fell at a Target store in Winter Garden, Florida, in December 2019. The jury awarded the money on Friday.

According to WFTV, the woman turned down a pre-trial settlement of $250,000 before securing the much-larger verdict payment.

The outlet reports that the woman was carrying her daughter and weaving through parked cars to dodge holiday traffic and puddles.

The woman reportedly didn’t see a landscaping island, where the curb caused a “notable and abrupt change in elevation.”

The woman reportedly stepped onto the uneven surface and twisted and fractured her ankle, but she tried to hold onto her child and ended up in an “awkward, pretzel-like position,” WFTV reports.

The woman fractured three bones in her ankle, including her tibia, fibula, and lateral malleolus.

Target was found to be “90% at fault,” according to the Orange Observer, because the “uneven surface and abrupt change in elevation” of the landscaping island violated several building codes.
