Prosecutors recommend sentencing two former officers in Tyre Nichols’ case to nearly 13 years in prison

In the federal trial, Tadarrius Bean and Justin Smith were found guilty of obstruction. They were acquitted for three other counts.

MEMPHIS, Tenn. — United States prosecutors submitted sentencing recommendations for two former Memphis Police Department officers involved in the traffic stop leading to the deadly beating of Tyre Nichols.

Justin Smith and Tadarrius Bean currently are set to be sentenced on June 16. In court documents filed on June 9, prosecutors asked the judge to sentence them to 151 months — about 12 and a half years — in prison.

In the federal trial, Bean and Smith were found guilty of obstruction. They were acquitted for three other counts.

For Bean, the attorneys recommended the sentencing “particularly to recognize the seriousness of the offense and to promote general deterrence to others in law enforcement.”

Smith and Bean, along with Demetrius Haley, were found not guilty on all state charges including second-degree murder and aggravated kidnapping, on May 7, 2025.
