Nearly $47 million verdict won after Tennessee girl injured during birth

NASHVILLE, Tenn. (WSMV) – A Middle Tennessee family is receiving a record payment after winning a lawsuit against Ascension St. Thomas Midtown.
A jury awarded the Boughton family nearly $47 million after their daughter suffered permanent injuries during her birth in 2018.
The jury ruled that one doctor and two nurses were negligent when giving care to the newborn baby, which led to significant injuries.
The family was awarded $23 million for future medical care and services along with more than $20 million for the pain and suffering the hospital staff caused the young girl.
This is the largest verdict of its kind in Tennessee history.
K&L Gates LLP released the following statement following the verdict:
On April 26, 2024, global law firm K&L Gates LLP secured a $46,993,500 verdict for a young girl stemming from permanent injuries sustained during her birth in 2018. The verdict, which was decided by a jury in the Davidson County Circuit Court following a three-week trial and two-and-a-half days of deliberations, is the largest verdict of its kind in Tennessee state history.
